The state may not tell you, but there could be a surplus fund waiting for you to claim.
You may be entitled to receiving a surplus fund and My Silent Heroes are here to help you do that.
If there is a difference between the taxes owed with interest of your property and the amount the property was sold for, this is called a Surplus Fund. Due to the recent economy, surplus funds have been ranging anywhere from tens to hundreds of thousands of dollars per property.
However, most previous property owners are not made aware of this surplus fund they need to claim nor the limited time frame to claim it, therefore, millions of dollars are currently unclaimed with the state.
Fun Fact: Lenders are legally not allowed to make any profits from foreclosure sales.
If your Florida property was sold in a tax deed auction for MORE than what you owed the county, the additional money is transferred to a Surplus Fund and you have a limited amount of time to claim these funds before they are transferred to the state.
For example, if your property was sold for $50,000 and you still owed $10,000 in taxes on the property , the remaining $40,000 would be considered a “Surplus Fund” which belongs to you the previous owner.

Surplus funds are only held by the Clerk and Comptroller for one year. If no claim has been filed within one year from the date of the Notice of Surplus Funds, all monies pertaining to that fund will be transferred to the State of Florida for holding.
Unfortunately, no one from the state is in charge of finding the owners of these claims so the money tends to stay with the state.

No, the surplus fund is the amount left over AFTER the property was sold. In Florida any liens holders have 120 days to claim any money that was owed to them out of the surplus funds. After 120 days any funds left over is due to the previous property owner.
Unfortunately, any home with a surplus fund has already been auctioned and sold to a new owner.
